  • Established alter-ego relationship between individuals and living trusts, and the analysis for the determination of "constructive notice" under California law.

  • Obtained 50% equitable contribution for a film production company's insurers against a studio's insurers for injuries suffered on studio controlled property, although unable to persuade court to shift entire loss to studio's insurers based on studio's "sole negligence."
  • Sought to limit statutory exception permitting enforcement of insurance policies for 3rd party "sole negligence" to assure insurance benefits for injured persons, but not as between concurrent insurers. Argued that public policy interests to promote workplace safety and the fair allocation of insurance costs require allocation of entire loss to responsible party's insurer(s), a position we believe should and eventually will be the law.
